This website and application are managed by the Cinemaxsai team. Throughout this document, the terms "we," "us," and "our" refer to Cinemaxsai. By accessing our platform and using our AI generation services, you agree to comply with the terms, conditions, and policies stated herein. These Terms apply to all users, including creators, subscribers, and browsers.

AI Service Usage & Account

Eligibility: You must be at least 18 years old (or the age of majority in your jurisdiction) to use our services.
Prohibited Content: You are strictly prohibited from using Cinemaxsai to generate, upload, or share content that:
- Is unlawful, threatening, or defamatory.
- Contains sexually explicit material or child sexual abuse material (CSAM).
- Infringes on the intellectual property, privacy, or publicity rights of others.
- Promotes discrimination, hate speech, or violence against individuals or groups.
- Involves "deepfakes" or deceptive imagery of real individuals without their express consent.
Termination: Violation of these content rules will result in immediate termination of your account and service access without refund.

AI Content Policy & Zero-Tolerance Enforcement

Zero-Tolerance Policy: Cinemaxsai maintains a zero-tolerance policy regarding the attempt to generate, upload, or distribute prohibited content. Our systems are equipped with safety filters and monitoring tools to detect violations.
Prohibited Content Categories: You are strictly prohibited from using our AI models to create:
- Child Sexual Abuse Material (CSAM): Any content depicting the exploitation or abuse of minors. We will report such activities to the National Center for Missing & Exploited Children (NCMEC) and relevant law enforcement agencies immediately.
- Non-Consensual Sexual Content : Any AI-generated media that depicts real individuals in sexual or compromising situations without their express, documented consent.
- Extreme Adult & Illegal Content: Including but not limited to graphic violence, non-consensual sexual acts, and illegal substances.
Enforcement Actions: Any attempt to bypass our safety filters or generate the content mentioned above will result in:
- Immediate and permanent account suspension without notice.
- Forfeiture of all remaining credits or subscription balances (no refunds).
- Permanent IP and device blacklisting from our platform.
- Reporting to Law Enforcement: We reserve the right to cooperate with global legal authorities and provide user data, logs, and generated content if a criminal violation is suspected.

Intellectual Property & Content Ownership

User Responsibility: You are solely responsible for the input (prompts, images, or data) you provide to the service.
Ownership of Output: Subject to your compliance with these Terms and payment of applicable fees, Cinemaxsai hereby assigns to you all its rights, title, and interest in and to the output generated by the service based on your prompts.
Usage Grant: By using the service, you grant Cinemaxsai a non-exclusive, royalty-free, worldwide license to host, cache, and use your generated content for the sole purpose of providing and improving the service.

Billing, Subscriptions & Refunds

Pricing: All prices for subscriptions or "credits" are subject to change. For users in specific regions , local currency pricing will be applied at checkout.
No-Refund Policy: Due to the high computational costs of AI generation, all sales are final. Refunds are only issued at our sole discretion or where required by local law.
Account Accuracy: You must provide current and accurate billing information. Failure to do so may result in service interruption.

Prohibited Uses (AI Specific)

In addition to general prohibitions, you may not:

Use any automated system to extract data from the platform.
Attempt to reverse-engineer the AI models or bypass safety filters.
Use the service to develop competing AI models or tools.

Disclaimer of Warranties (AI Output)

"As-Is" Service: Our AI tools are provided "as-is." We do not guarantee that the generated content will be accurate, consistent, or meet your expectations.
Artifacts & Errors: You acknowledge that AI-generated media may contain technical artifacts, glitches, or unexpected results. Cinemaxsai is not liable for any dissatisfaction with the aesthetic or technical quality of the output.

Limitation of Liability

Cinemaxsai and its affiliates shall not be liable for any indirect, incidental, or consequential damages (including loss of profits or data) arising from your use or inability to use the service, even if advised of the possibility of such damages.

Indemnification

You agree to indemnify and hold harmless Cinemaxsai from any claims, damages, or legal fees arising from your breach of these Terms, specifically regarding any illegal or infringing content you generate using our AI tools.

Taxes and Duties

Applicable taxes and duties will be included in your purchase total based on your location and local regulations. For international transactions, you are responsible for any local import taxes or fees.

Governing Law

These Terms are governed by and interpreted according to the laws of Hong Kong. Any disputes shall be submitted to the exclusive jurisdiction of the courts in Hong Kong.

Changes to Terms

We reserve the right to update these Terms at any time. Your continued use of Cinemaxsai following any changes constitutes acceptance of the new Terms.

Subscription Terms

These Subscription Terms govern your access to and use of Cinemaxsai’s premium AI services. By initiating a subscription, trial, or any purchase, you agree to these terms.

Trial & Introductory Offers

Trial Period: We may offer discounted trial periods to new users.
Automatic Conversion: To ensure uninterrupted service, trials automatically convert to a full paid subscription at the end of the trial period.
Cancellation Deadline: If you do not wish to subscribe, you must cancel at least 24 hours before the trial ends. Upon conversion, the applicable subscription fee for your selected plan will be charged to your payment method automatically.

Subscription Billing & Renewal

Billing Cycle: Subscriptions are billed in advance on a recurring basis (Weekly, Monthly, or Annually).
Automatic Renewal: Your plan will automatically renew at the end of each cycle unless canceled.
Credits/Usage: Subscription plans may include a specific allotment of "AI Generation Credits." Unused credits do not roll over to the next billing cycle unless explicitly stated in your plan.

Payment Authorization

By subscribing, you authorize Cinemaxsai to charge your designated payment method for:

Initial trial or subscription fees.
Recurring renewal charges.
Any "Top-up" credits you purchase. You are responsible for maintaining accurate billing info to avoid service interruption.

Cancellation & Access

How to Cancel: You can cancel anytime via your Account Settings or by emailing support@cinemaxsai.com.
Effect of Cancellation: Cancellation stops future billing. You will retain access to premium features and any remaining credits until the end of your current paid billing period. No partial refunds are provided for the remaining days in a cycle.

Pricing & Plan Modifications

Cinemaxsai reserves the right to adjust pricing or modify the features (such as video resolution, generation speed, or AI models) included in each plan. We will notify you of significant price changes in advance. Continued use after a price change constitutes acceptance of the new rate.

Strict No-Refund Policy

Digital Nature of Service: Due to the immediate and high computational costs (GPU resources) incurred when generating AI videos/images, all payments are final and non-refundable.
Exceptions: We do not offer refunds for "accidental" renewals, unused credits, or dissatisfaction with AI-generated results. Refunds are only granted if required by local law or due to a verified technical failure on our end that prevented service delivery.

Abuse of Subscription

We reserve the right to suspend or terminate subscriptions without refund if we detect "account sharing," automated bot usage of the interface, or any attempts to reverse-engineer our AI generation pipeline.
